Penn State ex-president Graham Spanier, former athletic director Tim Curley and former vice president Gary Schultz have been bound for court on the charges against them in the Jerry Sandusky child sex abuse case.
Dauphin County Judge William Wenner found enough evidence to warrant a trial for three after a two-day preliminary hearing in Harrisburg.
Former Penn State assistant football coach Mike McQueary testified as part of the hearing that Curley and Schultz knew what was going on...

Spanier's grand jury testimony during the Sandusky trial was read in open court in the morning session where it was disclosed that, according to Pennlive's Charles Thompson:
Prosecutors alleged that Spanier lied when:
He told the grand jury investigating former Penn State football assistant Jerry Sandusky that he never understood the 2001 incident to involve the abuse of a child.
He told the same panel that he was never made aware of any prior accusations against Sandusky. Records show Spanier was copied on at least some of the updates between Schultz and Curley on that case.
Schultz and Curley are already charged with perjury and the prosecution has to prove the statements were false to get a conviction to stick.

Paterno Family Trying To Unring The Sandusky Bell

It is all carefully staged at this point...
The first salvo was the Sue Paterno open letter trying to explain who her late husband, Joe, really was...
Now, before Sue Paterno gives, what surely will be, an emotional interview with Katie Couric...
ESPN has timed and cooperated with an embargo of a report co-authored and researched by former Pennsylvania Governor Dick Thornburgh (among others) who addressed the self-thought of "holes and inaccuracies" in the Freeh Report...
To refute, somewhat, coach Paterno could probably have issues spelling the word e-mail- much less understanding what it is and how to use it within the Penn State system. If Freeh anointed himself "judge, jury, and executioner" then the issues are to be with the university for signing off on the conclusions- not Freeh or the NCAA.
The issues should be resolved with the school as the family tries to reclaim what's left of a tattered reputation.

Mr. Paterno was on notice for at least 13 years that Sandusky, one of his longest serving assistants, and whose office was steps away, was a probable serial pedophile. Mr. Paterno was aware of the criminal 1998 investigation into Sandusky's suspected child sexual abuse. Indeed, the evidence shows that Mr. Paterno closely followed that case. Later, in 2001, another one of his assistants, Mr. McQueary, directly reported to Mr. Paterno that Sandusky was sexually abusing a young boy in Mr. Paterno's Penn State football locker room. The evidence shows that Mr. Paterno purposefully ignored this evidence.
So, to the Paternos, good luck in your Pee-Ahr campaign. It will be interesting to see how many of us outside of State College buy what you're selling...

State Of PA Taking NCAA To Court Over Penn State
The Governor of the state of Pennsylvania, Tom Corbett, is planing on coming forth with a lawsuit against the NCAA for their actions against Penn State University that included the huge eight figure fine, extensive bowl ban, vacated wins under Joe Paterno as head football coach, and scholarship reductions.
A press conference is scheduled Wednesday to explain where the state is coming from...
The school, while already having agreed to the implentation of the NCAA sanctions in July, is not a party to the actions of Governor Corbett- but the HQ can fairly assess that they have been kept in the loop on the whole thing.
The suit should challenge the notion of the NCAA as a governing and enforcement body, and will have to answer to the thought that elected officials inside the state of Pennsylvania wanted the fines against the university to stay at home.
Currently, the fines are being distributed on a national basis for preventing child abuse. Both sides are not addressing this idea publicly...
At the same time, the case brought forth by Mike McQueary against the university is still scheduled to proceed without any kind of delay. McQueary claims he was wrongly fired by the school.

More Sandusky E-Mails May Lead To Confirmed Cover-Up

Not that the HQ is shocked or anything, but the report below is claiming that Penn State tried to figure out a more "humane" way to figure out a solution where the Jerry Sandusky case was concerned...
And it's something that had been hinted at during the trial and shortly after the verdict.
The 2001 incident involving Mike McQueary's stumbling in on an incident in the Penn State showers is the one where the alleged e-mails came forward involving then-President Graham Spanier, then-VP Gary Schultz, and then-AD Tim Curley who were trying to figure out what the best internal approach could be before notifying authorities...
In said e-mails, according to several reports, not only did Spanier, Curley and Schultz express concern over what was reported, but so did former head coach (now deceased), Joe Paterno.
An e-mail from Curley to Schultz and Spanier is truly damning. It describes conversation the former Athletic Director had with Paterno: "After giving it more thought and talking it over with Joe yesterday, I am uncomfortable with what we agreed were the next steps. I am having trouble with going to everyone but the person involved. I would be more comfortable meeting with the person and tell them about the information we received and tell them we are aware of the first situation,"

BREAKING: Sandusky found guilty of sexual abuse

BELLEFONTE, Pa -- Former Penn State University football coach Jerry Sandusky's trial is officially over.
A Centre County jury has found Sandusky guilty of 45 of the 48 counts of child sexual abuse of which he was accused.
A jury of seven women and five men deliberated for the bulk of two days before reaching a verdict Friday night. The jury started going over testimony by former Penn State assistant coach Mike McQueary around 9am this morning.
Sandusky now faces a maximum sentence of 442 years in prison.

Now that the jury has spoken, the University wants to continue that dialogue and do its part to help victims continue their path forward. To that end, the University plans to invite victims of Mr. Sandusky’s abuse to participate in a program to facilitate the resolution of claims against the University arising out of Mr. Sandusky's conduct. The purpose of the program is simple – the University wants to provide a forum where the University can privately, expeditiously and fairly address the victims' concerns and compensate them for claims relating to the University. Counsel to the University plan to reach out to counsel to the victims of Mr. Sandusky’s abuse in the near future with additional details.

Here's the rundown of the case charge-by-charge, thanks to our friends at WHP-TV... the HQ would agree that 45-out-of-48 is a good save percentage...
Naturally, Sandusky attorney Joe Amendola plans to appeal on the grounds of questionable legal decisions in and by the court during trial...
"If you win on one of the appeal issues, everything probably falls," attorney Joe Amendola said. "So all we have to do is convince an appellate court that one of the issues that we will raise is worthy of a reversal. ... It doesn't matter, it could be 100 counts, and it would still all come back if an appeal is granted."
The jury deliberated 21 hours over two days and Jerry Sandusky is now on suicide watch.
The next questions will fall with former Penn State vice president Gary Schultz and former Athletic Director Tim Curley for perjury and failing to report the abuse. Will the NCAA continue their investigation and to what extent...???

Sandusky Day 2: Penn St in deep doo-doo and tough testimony

Day 2 of testimony in the Jerry Sandusky trial revealed more of the details on what only can be called a horrible life lived by victims and more insight to what appears to be the depth of Sandusky's apparent depravity.
It also called into question just how much people in and around Penn State knew about Sandusky's alleged exploits.
Aside from the testimony, reports indicate that former Penn State vice president Gary Schultz appears to have kept a "Secret" file on the former football assistant coach with information about the highly reported "Shower Incident". Yes, it appears that former Penn State president Graham Spanier, AD Tim Curley and others knew about it too.

And yes, it appears most of the higher ups at Penn State totally lied about what they knew. NBC reported Monday night that Schultz and Spanier discussed Sandusky back in 2001 and Spanier allegedly said It wouldn't be "humane" to involve authorities with Sandusky's issues.
Really? We are going to avoid the anger that is bubbling at the surface about this.
Also today, in somewhat of a surprise, former assistant coach Mike McQueary took the stand to talk about what he saw in the now infamous "Shower Incident" at the team facility. He testified that he had heard "Slapping" types of noise coming from the shower. He believed he saw Sandusky in a mirror engaged in what he believes to be a "Sexual Act" and hit a locker to let the people in the shower know he was there.
McQueary's testimony reinforced most of what he had said previously with the addition that he was so stunned at what he saw after making eye contact with Sandusky that he panicked and immediately called the person he trusted the most...his father.
He also testified about going to former coach Joe Paterno's home the next day to tell him, but that out of respect and fear, he didn't not name names.
Defense attorney Joe Amendola tried to discredit McQueary by saying that he was "In it for the money like the other defendants". Amendola claims McQueary's inability to remember the exact date is the reason for his doubt. And that is central to the defense strategy, create any kind of doubt they can.
Finally, the 2nd of Sandusky's alleged victims took the stand. And the now 18-year-old's testimony was both riveting and revolting.
He spoke in detail about suffering through incidents on a water bed in the basement of Sandusky's home. He tried, with tears in his eyes, to describe Sandusky's attempt at foreplay, and eventually acts of sexual behavior.
His story continued until he told of what happened upon his entry into High School in 2008. And he told jurors how he began leaving hints at a problem to his mother, who eventually went to authorities.
Other than a preliminary investigation, one that later was discovered a Pennsylvania State Trooper believed to be true, nothing happened.

Jesus.
This just gets more and more difficult to comprehend. How can anyone who worked at the top levels of Penn State administration back then look at themselves in the mirror?
Yeah, that's you we are talking about Schultz, Spanier and Tim Curley.
It's so hard...and painful to hear about what happened. And as much as we'd all like to think that we would have immediately reacted, that isn't always the case. Abuse like this...it's one of those things that you just can't know until you know. Whether there were obvious signs or not.
That statement in no way, shape or form justifies anything that happened here, but think about it from the victims perspectives. Would you just immediately tell somebody something like that happened to you when you are a kid? And if you are an adult who doesn't really know the signs of Pedophilia, would they jump off the page at you?
Let's just hope this gets over with sooner rather than later. And let's hope somehow, someway, both those who appear to have protected this monster and the monster himself have attracted the attention of Karma...who has a way of coming back to collect overdue bills.

Report: Mike McQueary sues Penn State

This is yet another offshoot of the Jerry Sandusky story that won't go away.
Mike McQueary, who may or may not still be an assistant coach at Penn State is suing the school, claiming that he's being unfairly persecuted in a "Whistleblower" case.
Yeah, it's getting strange. And McQueary wants money.

One way or another, McQueary is going to be a key witness in the Sandusky trial, which is going to start some time later this year.
His claim that he saw Sandusky fondling or appearing to be involved in a "Sex Act" with a child back in 2001, is one of the highlights of the 50-plus charge case against Sandusky, a former Penn State assistant coach.
And oh, there are now reports that McQueary may have been mistaken on the date of the incident, that McQueary has been saying it happened in early 2002. A judge recently ruled that prosecutors can change that date...to early 2001.
Unfortunately, the lawyers are going to pick that inconsistency apart in trial.
Which is somewhat unfortunate and one of the multiple flaws in our opinion, of the legal system. Think about it. How many of you can state an exact time and date of an incident that happened 10 or more years ago? Yeah, it may have been traumatic, but who amongst you (honestly) can remember excrutiating details from events that far back? You will probably remember the major points of it. You may remember some of the details, but unfortunately, in court you are going to have be EXACT or you are going to get called out.
Don't interpret this as a defense of either McQueary or Sandusky. Unfortunately McQueary has a lot of questions to answer because his story has been wildly inconsistent. We just hope that isn't going to be the basis of Sandusky's defense because it certainly appears that there is a far deeper and wide ranging issue with him than just this "One" incident.

McQueary testifies about what he saw Sandusky do

And the buildup to the inevitable trial of former Penn State assistant coach Jerry Sandusky continues.
The latest. On Friday afternoon in a Harrisburg, PA courtroom, the preliminary hearing for Penn State Athletic Director Tim Curley and former VP Gary Schultz, who are accused of lying to the grand jury about what they knew.
The key testimony of the day. That of current PennState assistant Mike McQueary who apparently came across Sandusky doing something that didn't seem to be right with a 10-12 year old boy in the shower at the teams locker room facility.
McQueary told the courtroom he heard slapping sounds when he walked into the shower area and then saw Sandusky and the boy. He said Sandusky's hands were around the boy's waist.
McQueary added he never described the encounter as "rape" or "intercourse", but he believed based on what he saw and heard that was going on.
After he left the area, McQueary said he went home and told coach Joe Paterno what happened the next day. Paterno, in his statement to the grand jury said McQueary came to him and reported he saw something of a "Sexual Nature" but Paterno didn't press for details because he knew McQueary was very upset about what he had seen.
Paterno said he would pass on what he was told, but it was a week and a half later before McQueary would meet with Curley and Schultz and he told them the same thing. He said he believed both men took it seriously and was confident because of Schultz's position of overseeing campus police, the incident would be investigated.
It wasn't.
They both told the grand jury that McQueary never portrayed the seriousness of what he'd seen.
Sandusky's odd legal team has been trying to tear down McQueary's testimony and Curley and Schultz's lawyers also say it isn't enough to make the case legit.
The judge in the case didn't see it that way. District Judge William C. Wenner decided he had seen or heard enough.
He sent the case to trial.

There will be a preliminary hearing held in the cases of Athletic Director Tim Curley and former VP Gary Schultz.
The two men were charged with perjury after the grand jury report on Sandusky was released.
The report was formulated largely on the testimony of Penn State assistant coach Mike McQueary. McQueary allegedly saw Sandusky engaged in sex act with a young boy in a shower.
McQueary's story has been put in some question, he is expected to be the focal point of today's hearing and is expected to testify.

We hear that despite some reported discrepancy's in what McQueary said he saw, the public hasn't heard everything about his testimony. The gaps may show or clarify what has been released. Keep in mind a "Grand Jury" summary is just that, a summary. It doesn't detail entire transcripts.
Now...this all comes on the heels of what is arguably the creepiest comments yet by a Sandusky attorney. A legal consultant advising Sandusky's lawyer, attorney Karl Rominger, told a Harrisburg, PA TV station (WHTM) that Sandusky's admission that he showered with boys was because Sandusky was trying to "Help troubled children who don't have basic hygiene skills."
He added "Teaching a person to shower at the age of 12-14 sounds strange to some people, but people who work with troubled youth will tell you there are a lot of juvenile delinquents and people who are dependent who have to be taught basic life skills like how to put soap on their body."
Really!
Rominger later released a statement saying his statement has become "Somewhat exaggerated" by the media.
Uh...why would you EVER say something like that. To a TELEVISION station no less. It's one thing to make an excuse for something but come on...

First. Penn State has decided to pull wide receiver coach and recruiting coordinator Mike McQueary, a primary witness in the Jerry Sandusky investigation from Saturday's game against Nebraska.
In a tersely worded statement on the school's athletic website, the quote was: "Due to multiple threats made against assistant coach Mike McQueary, the University has decided it would be in the best interest of assistant coach McQueary not to be in attendance for Saturday's game."
Not exactly a statement of strength and unity there. While it is very disconcerting that people would be threatening bodily harm to McQueary, which should never be happening, his status and questions about what he did in the investigation have become somewhat of a lightning rod.
Penn State and their HORRENDOUS PR department should have addressed this long before Thursday night. There are many people saying McQueary should also be relieved of duty. His status apparently is not in question.
Also.
The Harrisburg Patriot-News gives us a very detailed and fascinating look at the timeline of events in the investigation surrounding Sandusky. It shows lots of small hints and indications there may be a problem, but none of those allegeations were either followed up on or taken seriously by most. The only group to take some proactive action; Central Mountain High School, where Sandusky was briefly a volunteer coach. He had been found in some questionable situations, including being found on top of a teen in an out of the way gymnasium. But nobody filed any charges.

Fascinating. And it also explains one of the big problems here and one of the big problems in any of these types of investigations.
Connecting the dots.
Sure, those of us not involved can sit back and say the evidence was "Right in front of you". But, this type of crime is something that you don't know....until you know.
We can indirectly say that this type of crime is so unimaginable and out of the norm that you can't believe it happened until someone tells you it did. As someone who has done many stories in the news world on this. Even close relatives miss obvious signs. They don't see what is in front of them. And short of actually seeing it happen, which Mike McQueary did, it is incredibly hard to process.
Without getting on the soapbox here, McQueary should have tried to step in and stop what he saw. There is no excusing that. Going to his boss the next day fulfilled his obligation to an extent, but it is also a decision he can't take back. You either do one thing or the other and don't get a do-over. The problem is, he can't come back and coach at Penn State now. He has no credibility. It will be nearly impossible for him to gain the trust of parents to let their kids come to Penn State.
The problem....from the get go...is that Penn State still seems unable to see this.

Going to his boss the next day fulfilled his obligation to an extent, but it is also a decision he can't take back. You either do one thing or the other and don't get a do-over. The problem is, he can't come back and coach at Penn State now. He has no credibility. It will be nearly impossible for him to gain the trust of parents to let their kids come to Penn State.
The problem....from the get go...is that Penn State still seems unable to see this.

BREAKING: BOT to Penn St.: McQueary needs to sit, Doctor Tom Wants Husker Fans Not To Wear Red

McQueary, you'll recall, is the graduate assistant who witnessed the alleged sodomizing of a 10-year-old by then assistant coach Jerry Sandusky in 2002. Rather than confront Sandusky, McQueary waited until the next day to inform now former head coach Joe Paterno.
According to published reports the Board of Trustees at Penn State is now asking interim head coach Tom Bradley to not allow McQueary to coach in Saturday's game against Nebraska. That flies in the face of Bradley stating in a press conference today that McQueary will coach. Let's see who wins this battle.
And McQueary is quickly becoming one of the focal points of this story. Commentators and writers throughout the country are asking: "Why did he wait until the next day to say something?" and "Why didn't he try to stop it?". And they are legitimate questions.
It appears that the folks in the formerly Happy Valley don't get it. Either that or their PR people need to be fired. McQueary can't coach on Saturday. He will be a sideshow. He will be the guy everybody in the building will be talking about. And arguably he and others on the field could be at risk by his mere presence.
We will withhold lambasting McQueary, who clearly should have done more than he did as well. In fact, we'd bet money, his first instinct was to worry about what he should say. In unfortunately, that is and was the wrong decision. But, considering the atmosphere and the way things seem to have been done in State College, it isn't surprising.

DC Tom Bradley had his first press conference as interim head coach and while there were some questions he wouldn't answer because of the impending criminal investigation, one element was discussed that is still a head scratcher...
Mike McQueary will still, as of now, be coaching on Saturday. No one knows if McQueary will be on the field (which would be risky) or in the press box (which will still be risky).
The gong show is still in force... and while his employment and current jobs are in question, Bradley gets to try and keep the team together against Nebraska...
