Penn St. Postseason Ban Lifted

It appears the harshest of the penalties being served by the Penn State athletic program in the wake of the Jerry Sandusky scandal are being lifted.

The NCAA announced Monday afternoon they've lifted the postseason ban they placed on the Nittany Lions. In addition, they will get the scholarship restrictions placed on them lifted after the current season ends.

Saying the school has made "Remarkable Progress" in making the changes prescribed after the horrific Sandusky case, the NCAA Board of Directors moved to take immediate action.

What they don't get back: The 112 forfeited wins. However, the NCAA is willing it appears to let the state of Pennsylvania keep the $60 million in fines levied against the state's largest school.

For those unaware, the Sandusky scandal refers to former long-time assistant coach Jerry Sandusky who was convicted of multiple charges of child molestation. During the investigation, it was found Penn State may have overlooked or not paid attention to the signs of a problem and covered it up. There was also a firm belief the football culture had overtaken the day-to-day life of the University and the people living in the community.

This years team under new Coach James Franklin is off to a 2-0 start and is likely to be a bowl eligible team with a shot at winning the blatantly mediocre Big 10.

Now they may get a chance to prove their worthiness on the field...

Sandusky Victims to Get $60 Million from Penn State

Wow...okay, Penn State must have a serious amount of money tucked away in its coffers.

The school announced Monday morning, they've reached settlements with 26 of the 32 people who made sexual abuse allegations against former Assistant Football coach Jerry Sandusky. Payments for those settlements according to the school--$59.7 million.

Penn State was quick to make clear the money would not come from tuition, taxpayer funds or donations, but rather a variety of insurance policies and other self-sufficient sources.

From the school's press release: "The Board of Trustees has had as one of its primary objectives to reach settlements in a way that is fair and respects the privacy of the individuals involved,” said Keith Masser, chair of the Board of Trustees. "This is another important milestone in accomplishing that goal. I would like to thank the board’s Legal and Compliance Committee, as well as its Legal Subcommittee for its leadership throughout this process.”

University President Rodney Erickson added; “We hope this is another step forward in the healing process for those hurt by Mr. Sandusky, and another step forward for Penn State. We cannot undo what has been done, but we can and must do everything possible to learn from this and ensure it never happens again at Penn State.”

Per multiple reports, part of the agreement has a confidentiality clause in it. That clause would not allow the victims or family members to disclose how much they received from the school.

In many ways, this ties up most of the loose ends in the 2009/10/11 case that saw the Nittany Lions former defensive coordinator arrested and charged with multiple cases of child sexual molestation, publicly humiliating the school and many of it's legends. Sandusky is in jail, where it appears he'll be for a very long time, the school administrators involved are no longer with the school.

No doubt the people of Happy Valley will be happy the saga has almost ended. The only curveball would be if Sandusky appeals his sentence.

Victim 5 First To Settle With Penn State

The inevitability in the Jerry Sandusky case is hitting Penn State a little harder now...

The Philadelphia Inquirer's Susan Snyder has the story of Victim 5's case against Penn State University now is settled for the ever-popular undisclosed amount.

It's the first of a reported 26 settlements expected among 31 young men who have claims over the former Penn State coach's actions and the school’s lack of a response until everything came cascading into the public view.

Victim 5's attorney, Tom Kline, told the Associated Press that his client attached his claim to Penn State, so the school would have a better shot at getting their money back from other sources more closely connected to Sandusky like his "The Second Mile" charity.

From Snyder:

Because the assault occurred so soon after the McQueary report and took place on campus, it was considered pivotal in reaching a settlement agreement with other victims, said Michael K. Rozen, a lawyer hired by the university to help settle the cases.

"The pivotal issue from the university's perspective in dealing with the victims is where the incident occurred and when it occurred proximate to the 2001 shower incident," Rozen said. " 'Number 5' is probably the singular one of the claims that has come to the university's attention where it absolutely, positively could have been stopped."


Sandusky is serving a 30 to 60-year state prison sentence for child molestation and related offenses.

DEVELOPING: 3 Ex-Penn State Officials Held Over For Trial

Penn State ex-president Graham Spanier, former athletic director Tim Curley and former vice president Gary Schultz have been bound for court on the charges against them in the Jerry Sandusky child sex abuse case.

Dauphin County Judge William Wenner found enough evidence to warrant a trial for three after a two-day preliminary hearing in Harrisburg.

Former Penn State assistant football coach Mike McQueary testified as part of the hearing that Curley and Schultz knew what was going on...

Spanier's grand jury testimony during the Sandusky trial was read in open court in the morning session where it was disclosed that, according to Pennlive's Charles Thompson:

Prosecutors alleged that Spanier lied when:

He told the grand jury investigating former Penn State football assistant Jerry Sandusky that he never understood the 2001 incident to involve the abuse of a child.

He told the same panel that he was never made aware of any prior accusations against Sandusky. Records show Spanier was copied on at least some of the updates between Schultz and Curley on that case.


Schultz and Curley are already charged with perjury and the prosecution has to prove the statements were false to get a conviction to stick.

Paterno Family Trying To Unring The Sandusky Bell

It is all carefully staged at this point...

The first salvo was the Sue Paterno open letter trying to explain who her late husband, Joe, really was...


Now, before Sue Paterno gives, what surely will be, an emotional interview with Katie Couric...
ESPN has timed and cooperated with an embargo of a report co-authored and researched by former Pennsylvania Governor Dick Thornburgh (among others) who addressed the self-thought of "holes and inaccuracies" in the Freeh Report...


To refute, somewhat, coach Paterno could probably have issues spelling the word e-mail- much less understanding what it is and how to use it within the Penn State system. If Freeh anointed himself "judge, jury, and executioner" then the issues are to be with the university for signing off on the conclusions- not Freeh or the NCAA.

The issues should be resolved with the school as the family tries to reclaim what's left of a tattered reputation.

Part of Freeh's response to the Paternos says:


Mr. Paterno was on notice for at least 13 years that Sandusky, one of his longest serving assistants, and whose office was steps away, was a probable serial pedophile. Mr. Paterno was aware of the criminal 1998 investigation into Sandusky's suspected child sexual abuse. Indeed, the evidence shows that Mr. Paterno closely followed that case. Later, in 2001, another one of his assistants, Mr. McQueary, directly reported to Mr. Paterno that Sandusky was sexually abusing a young boy in Mr. Paterno's Penn State football locker room. The evidence shows that Mr. Paterno purposefully ignored this evidence.

So, to the Paternos, good luck in your Pee-Ahr campaign. It will be interesting to see how many of us outside of State College buy what you're selling...

Paterno Family Begins Counterattack To Freeh Report

So it begins. Well over a year after it started, Joe Paterno's widow is telling the family's side of the Jerry Sandusky saga and they'll tell it on Monday.

Multiple outlets report that on Sunday morning, Sue Paterno will release a report she says will counter all the allegations the Freeh Report made against her husband.

And it will be released to the public on ESPN's "Outside the Lines" show.

No, really.

The report, rumored to be some 180 pages long and supposedly compiled by a "National Team of Experts", is reportedly a comprehensive rebuttal to the allegations that investigator Louis Freeh made in his report to the Penn State Board of Trustees.

You'll recall the Freeh report alleged Joe Paterno was part of a large cover-up by Penn State leaders to hide the behavior of convicted child molester Jerry Sandusky. The report provided documents stating Joe Paterno was aware there were issues with Sandusky and chose to try handling them internally rather than telling police.

Mind you, Paterno was not charged with anything. Sue Paterno believes her husband's name was besmirched and the humilation of her husband was too much to bear.

The story says the report will prove that Freeh did not "Thoroughly" investigate what happened and ignored details that would exonerate JoePa. She did not elaborate as to why Freeh would do that.

Oh, Sue Paterno will apparently state her case to the world Monday in an interview to be broadcast on the "Katie" show (syndicated, check local listings for time).

PA Governor Holds Presser, Says NCAA Actions "Unlawful"

Yeah, this was a little too good to be true...

Pennsylvania Governor Tom Corbett, who apparently, has nothing better to do with his time decided to take the NCAA to court over actions he claims are "unlawful" in administering the sanctions against Penn State in the wake of the Jerry Sandusky scandal.

Here's the press conference in its entirety...


"...the NCAA shouldn’t have sanctioned Penn State. I believe, and our suit contends, that the NCAA had no authority and operated outside of their own bylaws with these sanctions that they brought. This was a criminal matter, not a violation of NCAA rules,” Corbett said.

With all due respect, Penn State failed not only its students, supporters, student-athletes, boosters, backers, and the state itself. For the state to file an anti-trust lawsuit against the NCAA on the grounds of challenging a document that the school itself signed (which, State College will undoubtedly say was done under duress...), is pretty brash...

"Our complaint states that the NCAA forced Penn State’s new president to agree to its sanctions under threat of the death penalty for the Penn State football program for four years. It did so without conducting its own investigation and without following its own rules for reviewing potential infractions by its members,” Corbett said.

But paying attention to the Freeh Report was a bad idea...???

Corbett refers to the punishments as "harsh, unjustified and unprecedented."
What would the victims say about how they were treated...???

Donald M. Remy, NCAA Executive Vice President and General Counsel issued this statement to the media:

“We are disappointed by the Governor's action today. Not only does this forthcoming lawsuit appear to be without merit, it is an affront to all of the victims in this tragedy - lives that were destroyed by the criminal actions of Jerry Sandusky. While the innocence that was stolen can never be restored, Penn State has accepted the consequences for its role and the role of its employees and is moving forward. Today's announcement by the Governor is a setback to the University's efforts.”

And if Corbett, who is a trustee himself, didn't act like this over the summer... why does he get to act this way now...???

State Of PA Taking NCAA To Court Over Penn State

The Governor of the state of Pennsylvania, Tom Corbett, is planing on coming forth with a lawsuit against the NCAA for their actions against Penn State University that included the huge eight figure fine, extensive bowl ban, vacated wins under Joe Paterno as head football coach, and scholarship reductions.

A press conference is scheduled Wednesday to explain where the state is coming from...

The school, while already having agreed to the implentation of the NCAA sanctions in July, is not a party to the actions of Governor Corbett- but the HQ can fairly assess that they have been kept in the loop on the whole thing.

The suit should challenge the notion of the NCAA as a governing and enforcement body, and will have to answer to the thought that elected officials inside the state of Pennsylvania wanted the fines against the university to stay at home.

Currently, the fines are being distributed on a national basis for preventing child abuse. Both sides are not addressing this idea publicly...

At the same time, the case brought forth by Mike McQueary against the university is still scheduled to proceed without any kind of delay. McQueary claims he was wrongly fired by the school.

Spanier Arraigned In Sandusky Case

Graham Spanier, the former president at Penn State appeared in court today facing charges from his alleged involvement in the Jerry Sandusky scandal. He didn't speak to the media. Spanier's attorney, Elizabeth Ainslie, spoke for the both of them on the charges:

“It is absolutely ridiculous. Dr. Spanier was never given a chance to speak to this grand jury to give his side of the story and we look forward to the chance to present his side of the story in the future.”

Spanier was arraigned on charges of:
Endangering the Welfare of Children
Perjury
Obstruction
Criminal Conspiracy, and
Failure to report child abuse

Bond was set at $125,000. But the bond is unsecured, there is no cost involved unless he doesn't show up for his next court date of November 16th. Spanier was also told to forfeit his passport and that he can't leave the state of Pennsylvania.

DEVELOPING: Spanier Charged In Sandusky Case

The HQ figured we weren't far from this, but the Pittsburgh Post-Gazette newspaper is reporting that former Penn State President Graham Spanier has been charged in connection to the Jerry Sandusky scandal.

A source told the newspaper's Paula Reed Ward
that Attorney General Linda Kelly will announce at a noon presser that Spanier is facing perjury and obstruction of justice charges.

**Update**--That source was correct.

Spanier was forced to resign a year ago because of what went down...

The comprehensive report sanctioned by the school that former FBI Director Louis Freeh released said that Spanier knew about Sandusky and his history on campus, but he (Spanier) consulted with other university officials to cover the accusations up... which, of course, he and his lawyers deny.

From the Reed Ward piece:

Mr. Spanier said he never knew any details about the 2001 incident, and that at the time he was simply given a "heads-up" that others in his administration were dealing with Sandusky for engaging in "horseplay" in the shower.

The day before Mr. Spanier made those statements to the Pittsburgh Post-Gazette, attorneys on his defense team characterized the Freeh report as a "blundering and indefensible indictment." Further, they said they didn't believe the state attorney general had a "scintilla of evidence" that could support charges similar to those faced by Mr. Schultz and Penn State athletic director Tim Curley.

Another Sandusky Accuser Comes Forward

Forty years after the fact...and outside the whole Penn State thing...


All this comes on the same day that Sandusky was transferred to a prison in Pennsylvania that houses death row inmates. He will be in protective custody, getting exercise five days a week and showers three days a week. He will be in heightened security when he is not in his cell.

"We make individual decisions based on facts," Corrections Secretary John Wetzel said in a written statement. "Given the high profile nature of this individual, coupled with the nature of his crimes, this makes him very vulnerable in a prison setting."

Jerry Sandusky begins process to appeal conviction

--Sigh--

This isn't over yet. It appears the attorney's representing convicted serial child molestor and former Penn State defensive coordinator Jerry Sandusky plan on appealing his sentence.

Sandusky was sentenced to spend the rest of his life in prison just over a week ago. And according to the process filed with the sentencing, had but 10-days to file notice he plans to appeal.

He did.

Without trying to bog down in legal mumbo-jumbo, essentially the document says that the Prosecution failed to produce evidence Sandusky had any physical or sexual contact with the witnesses. And, they state there was no evidence provided his interaction with those witnesses were criminal in any way.

Oh boy.

Yeah, sure, it's not a total surprise that he's appealing. His attorney's whined the whole time they didn't have enough time (6 months) to prepare. And though Sandusky himself said nothing and didn't testify, he now proclaims "I did nothing wrong" and that he is the victim of some sort of conspiracy.

We'll spare you the condescending statement that he released to the press late last week and just say this: "Jerry, leave it alone dude. Even though you aren't coming to grips with it, you've made it plainly obvious you are sick enough that you don't believe what you did is wrong. It is. And with it comes the full punishment of the law."

Unfortunately, the people of Centre County will be footing the bill if this is appealed and if the remote chance a judge overturns the decision happens. Nobody in their right minds thinks it will be overturned, but the way the legal system is so focused on the technicalities of a prosecution, all it takes is even the slightest goof up to get your case overturned.

Sandusky Pension Probably Revoked, Family Letters Blame Everyone Else...

The state of Pennsylvania's public employee pension system has notified the Sandusky family that they're in the process of revoking Jerry Sandusky's state pension as a result of his conviction and sentencing this past week.

Sandusky's lawyer, Karl Rominger, has already said that Sandusky would fight any attempt to revoke his pension.

And, in a bit of a sidebar, the letters that Jerry and Dottie Sandusky wrote as part of their sentencing defense were released after judge John Cleland and Centre Court made the letters public. In them, the husband and wife, pretty much, blame everyone but themselves for the family's downfall: the victims, the media, the university, and the police.

Sandusky first laid this groundwork in a leaked radio interview the night before the sentencing...  

"My trust in people, systems and fairness has diminished," Sandusky said in part. "In my heart I know I did not do these disgusting acts. However, I didn't tell the jury. Our son changed our plans when he switched sides."

"There were so many people involved in the orchestration of this conviction (media, investigators, prosecutors, "the system," Penn State and the accusers.) It was well done. They won!"

Actually, coach, reality won for a change...

Just don't tell Dottie Sandusky...since she thinks her adopted son, Matt, is also at fault in all of this:  

"People need to know what kind of person he is," she wrote. "We have forgiven him many times for all he has done to our family, thinking that he was changing his life, but he would always go back to his stealing and lies. He has been diagnose (sic) Bipolar, but he refuses to take his medicine."

Uh-huh... keep talking...
It's just that no one is listening...

DEVELOPING:Sandusky Sentenced To 30-60 Years

Judge John Cleland issued the sentence of 30-60 years in jail on 45 counts of child sexual abuse, as Jerry Sandusky was convicted of molesting 10 boys over a 15-year period and using a charity he established as nothing less than a front for continuing his abuse and enacting consistent betrayal on minors. It had been three months after a jury convicted him on the charges

Sandusky maintains his innocence, says he is not a monster and says he didn't do the "alleged disgusting acts." The appeals process is going to start in the next few weeks...

Penn State President Rodney Erickson released the following statement:

"Our thoughts today, as they have been for the last year, go out to the victims of Jerry Sandusky’s abuse. While today’s sentence cannot erase what has happened, hopefully it will provide comfort to those affected by these horrible events and help them continue down the road to recovery."

The university still intends to settle with victims in a timely manner- as they well should...

Sandusky read a statement in open court:

“I feel a need to talk not from arrogance but from the heart. I did not do these disgusting acts. As I began to relive everything, it was a terrible feeling and my eyes filled with tears. Maybe some children who might have been abused will not be because of the publicity. The pain continues when I think about the people who’ve made the allegations. I’ve been confined to a small room. There are outbursts in the jail.”

“I told Dottie, ‘We’re definitely in the fourth quarter.’ Those who still believe in us are the only ones who matter. Not being able to hug my grandchildren, not being able to play with the dog. Yet, I get letters of support. I see family and friends, I see special inmates who smile at me."


In response at the sentencing hearing, some of the victims and their family representatives gave statements as well, from KDKA-TV:

Victim No. 9’s mother:

“I have had to endure my son’s suicide attempts all because of you. You’ve destroyed my family and I can never forgive you of that. Shame on you. Shame on you Mr. Sandusky,” she said.

Victim No. 1:

“There are no words to describe the pain and misery Jerry Sandusky has inflicted on my life. There are thoughts I didn’t want to think. I have been looking over my shoulder for a long time. There is no remorse in Jerry Sandusky, only evil.”


Victim No. 4:

“Rather than take accountability for your actions, you attacked us as though we did something wrong. I will never forgive you. I was in a troubled situation and you made it worse.”

Victim No. 5:

“He forcibly had me touch him. I am troubled with flashbacks of his naked body. I am tormented by nightmares and guilt. I will never erase the filthy images, but he must pay for his crimes. He took away my childhood the day he assaulted me. He should be sentenced accordingly.”

Victim No. 6:

“My personality changed for the worst. That night you called yourself the tickle monster so you could touch my 11-year-old body, has damaged me for life. The Bible says if we confess our sins he will forgive us. You are trying to speak forth your innocence. You are only fooling yourself. You won’t be able to receive forgiveness.”

Man Links Sandusky To Child Porn Ring

The New York Daily News is reporting that Greg Bucceroni a self-described former child prostitute, sent an email to officials at Poly Prep Country Day School in Brooklyn saying he was associated with a child sex ring that included former Penn State coach Jerry Sandusky and embattled former Poly Prep (NY) football coach Phil Foglietta.

In 1979, Bucceroni claims he was supposed to have sex with Sandusky, but ended up with Foglietta.

Twelve alumni of Poly Prep have filed a lawsuit for $20-million a piece against the school claiming they were raped by Foglietta during his tenure as head football coach. The suit claims school officials knew about what Foglietta was doing and covered it up.

The NY Daily News article by Christian Red says Foglietta, who died in 1998, was attached to Second Mile and was even offered a job to be an assistant at Penn State at one point.

The irony is inescapable at present...

Graham Spanier (former Penn St prez) goes on the Offensive

Well, it certainly took awhile.

A mere 2 months after the scathing Freeh Report from Penn State that vilified former school President Graham Spanier, Spanier finally is responding.

Wednesday morning one of his lawyers held a Press Conference in Philadelphia saying that the Freeh Report on how the Jerry Sandusky scandal was handled was "Nothing short of absurd" and that there was nothing in it that incriminated his client.

And...he's right, his client isn't charged with anything other than ignoring warnings of a sexual predator in his midst on the premise of "Protecting the Penn State Way". Which for some strange reason seems to be everyone's defense of this. Now, yes, we are aware the Grand Jury in Centre County may be investigating him, but thus far, no charges are forthcoming.

Oh...did we mention that Spanier was interviewed by Josh Elliot of ABC and the interview "Coincidentally" will be airing Wednesday night?

Okay.

First thought: This is an attempt to try and salvage Spanier's career in academia. And it's already too late. Does anyone not think this is the pleading of a desperate man? If Spanier is so "Innocent" why was there not an "Immediate" retort? Could we have possibly been plotting a way to respond while not trying to sound as guilty as he does in the Freeh Report?

We kind of hate to publicize stuff like this, but it's all over the mainstream media now. And we'll get a full day of breathless ABC teases saying things like "Graham Spanier, what did he know about Jerry Sandusky? He speaks to our Josh Elliot, that story LIVE at 6:30"

And yeah, if we weren't on vacation, we'd probably watch...

Curley And Schultz Set For January Jury Selection

The trial for Tim Curley and Gary Schultz is now scheduled to begin January 7th. They are accused of lying to a Pennsylvania grand jury and not disclosing the McQueary information relating to what he claims to have witnessed Jerry Sandusky do on campus in 2001.

Dauphin County ((PA)) Judge Todd Hoover is still considering motions by Curley and Schultz's lawyers to throw out the charges. Curley is on leave from his job as AD (still getting a salary) and Schultz is retired as a university VP.

PSU Trustees File Suit Against NCAA, Spanier and Schultz Still Getting Paid

Don Van Natta is at it again- in a good way...

As he has uncovered that some of the current members of the Penn State Board of Trustees have filed a lawsuit against the NCAA ordering the elimination of the judgment, lawsuit, and anything else associated with the ruling that came down from Indianapolis...

Basically, the four trustees at the front of the suit claim the suit is "null and void" since the assertion is that President Rodney Erickson didn't have the authority to unilaterally sign the consent decree that the school and NCAA agreed to in the first place.

Ryan McCombie, a new member on the Board, claims that there was a lack of due process, the consent decree was based erroneously on the Freeh Report and the report alone, and that the damage done is "excessive" to an entire generation...

Also, two of the more important and checkered individuals associated with the scandal on campus are still getting paid- Graham Spanier and Tim Curley.

Spanier was fired in November, but he’s a tenured professor. But tenuired professors are protected- from, apparently, everything. In 2011 Spanier made more than $700,000 with pay and benefits.

Curley went on leave right after Sandusky’s indictment, so he is still being paid. According to the Penn State website, he makes close to $400,000.

Alleged Sandusky Voice Mail Says "Love You" To Victim

On the same day that the wife of convicted child molester Jerry Sandusky said that the public doesn't know who the real person is, an alleged voice mail has surfaced where he leaves an odd salutation...

The attorneys of the allged victim say the voice mails, recorded in fall 2011, are proof “Sandusky was attempting to exert control over our client even as his arrest for child sexual abuse became imminent.”

The attorneys who released the audio also represent victims 3, 7, and 10 and Sandusky’s son Matt in addition to this unknown alleged victim.

And if you're not creeped out before the trial, this should show you that the whole culture in State College is still leaving a lot to be desired.
