FSU to Make Winston Face Disciplinary Hearing

Overnight, word leaked out the Florida State University notified the lawyer for star QB Jameis Winston that he will be facing a disciplinary hearing.

The hearing is about the charges he sexually assaulted a woman back in December of 2012.

The investigation of that assault has been highly controversial, with charges that police and FSU officials helped to try diverting attention from what happened. And that they were less than forthcoming with the district attorney's office once word got out and an official investigation into charges began.

Mind you, the hearing is only to determine if he should be charged according to the school's code of conduct rules. If charged, he could be facing 4 different violations.

The hearing should take place sometime during the week.

The perception by many outside of Tallahassee is FSU is executing a "CYA" move. They've had numerous opportunities to move in this direction in the past 20 months, but until now, have done nothing.

It should be noted Florida State is being investigated for Title IX violations in the way they handled this case and a FOXSports report on Friday detailed evidence they were not exactly forthcoming in sharing information with prosecutors investigating what happened.

We suspect nothing significant will come out of this, despite Mr. Winston's continuing lack of good behavior. But we could be wrong.

Jameis Winston "Cooperating" With Title IX Investigation... Was There An Attempted Extortion...?

While the attorney for FSU QB Jameis Winston, David Cornwell, admits that his client is cooperating with the Title IX investigation on campus, he also says that the accuser in the previous rape case tried to extort money from his client.

$7-million worth of being left alone...

TMZ has a copy of the letter and it claims that the accuser's attorney, Patricia Carroll, was ready to deal:

According to the letter -- obtained by TMZ Sports -- the alleged victim's lawyer, Patricia Carroll, demanded $7 MIL to settle her client's claims against FSU and Winston, telling Cornwell, "If we settle, you will never hear from my client or me again -- in the press or anywhere."

Cornwell says he rejected her offer and 4 days later she went to the media.


Fisher is now ready to move on and make sure that his quarterback is going to not get into any more trouble.

The HQ still has tremendous issues with Winston even being on the field Saturday. We always thought "suspended" meant something the equivalent of staying at home, not being in attendance, and learning some kind if lesson in all of this.

The HQ doesn't buy the whole "miscommunication" gambit and the idea that the network broadcasting the game actually had 48 cut-aways (as counted by Deadspin) of him watching his team on the sidelines is appalling.

The glorification of a suspended athlete has nothing to do with subplot and it wouldn't have if he was off the field- where he belonged- in the first place.

The HQ is also not fond of Winston jumping into the middle of Sean McGuire's moment after the win and we're fairly sure there's a huge disconnect in Winston's brain when it comes to "getting it."

Which he, surely and consistenty, has not and will not. Entitlement and coddling are two words that seem to be fairly consistent in the administration of Winston's life path and we're pretty tired of it.

There's nothing wrong with being a "heel." Each sporting element has them and needs them for the sake of daily argument. But Winston, through all of his instances, has gone past that role into one of an individual who we're all waiting to fall and won't have any sympsthy when he does.

FSU Reopening Winston Title IX Investigation

Not surprising to the HQ at all, but this was the initial report OSG Sports gave on the Title IX investigation in and around the Florida State QB in the off-season.

It appears the university is now reopening the Title IX investigation that the alleged Winston rape victim requested at the time. Jameis Winston did not answer any questions in the initial investigation, so it was tabled.

The investigation was widely panned and the New York Times constructed all of the errors in one place.

Tha attorney for the accuser, John Clune, says that his client feels that the process is "moving forward" after his client was interviewed last month for an incident that happened in 2012:

"We expect that there will be code of conduct charges that will be brought," he told Rachel Axon of USA Today. "There's no basis not to bring those charges now."

During the criminal investigation, Winston (through his lawyers) maintained that the sexual contact was consensual.

But an on-campus Title IX investigation gets around the criminal complaint:

Decisions are made on a "preponderance of the evidence" and should, as a rule, take no longer than two months to complete. That would, then, make the decision public in the neighborhood of Week 10 of the college football season.

And could send the FSU football season into a tizzy for the next 8 weeks or so...

Tulsa Facing Title IX Lawsuit Over Hoops Player

Pat Swilling was a tremendous linebacker for Georgia Tech and the New Orleans Saints...

His son is a promising basketball player at Tulsa University. But the younger Swilling is in the middle of a firestorm at the moment involving a lawsuit filed in a federal court Monday that claims the school failed to protect a female student from an individual with a past of alleged sexual indiscretions.

Swilling, in the suit, is detailed to have been in three previous incidents involving attempted or alleged sexual assaults- one in Idaho at his previous school, one at Tulsa, and another incident in town off campus.

It's a heavy list of accusations and part of a larger investigation that ESPN is doing...

And Lavigne's story is must reading hyah on all three previous instances and the holes in the system in both Idaho and Tulsa...

In late April, the Tulsa DA's office didn't press charges against Swilling. Swilling's attorney, Corbin Brewster, said the allegations made "were not credible."

President Stedman Upham said, in a prepared statement released to the media, that Tulsa stands by its Title IX practices:

"The safety of University of Tulsa students, faculty and staff is our top priority at all times. The university has a robust policy to investigate allegations of sexual harassment and sexual assault in a thorough and deliberate manner.

Although this legal filing has been widely distributed to media outlets, the lawsuit has not been served on the university. As such, we have not yet been able to thoroughly review the lawsuit; but, from media reports, it appears misinformation already is developing regarding our handling of this matter.

This process was carried out fully and completely in the case in question, including communicating the official policy to all parties involved. As soon as the incident was reported, university administrators immediately began the investigation process.

We conducted our investigation in a fair and timely manner, cooperating fully with local law enforcement.

TU's policy on sexual violence is far-reaching; and although investigation is a critical component, our plan to protect our students extends well beyond. This policy includes a proactive approach to ensuring student safety, which is reviewed and updated annually, if not more frequently. During the previous academic year, the university has taken steps to further protect students, including limiting access to campus, implementing a Rape Aggression Defense program and coordinating an initiative called iStand to fight sexual violence.

TU's policy on sexual violence was developed using recommendations from the White House Task Force to Protect Students from Sexual Assault. Leading this effort was our Dean of Students assisted by university legal counsel, the Title IX coordinator and members of TU's Sexual Violence Prevention and Educational Programming Committee (commonly referred to as the Advocacy Alliance), which is comprised of faculty, staff and students from the following departments: Student Affairs, Counseling Services, Campus Security, Athletics, Psychology (including the Institute for Trauma, Adversity and Injustice), and Housing and Residential Life.

As TU welcomes its freshman class, these students will learn what other TU students and alumni already know, which is their safety and well-being is and remains our foremost priority."

Stanford Removes Strength Coach After Title IX Investigation

A Stanford University sports performance coach is out of a job after softball players reported allegations of sexual harassment within the program.

The school's Title IX coordinator investigated the softball team’s coaching and training staff and found a member of that staff created a "sexually hostile work environment."

The softball team’s head coach, John Rittman, resigned back in June.
But there has been no public connection to the investigation and his dismissal.

55 Schools Under Title IX Sexual Assault Probe

This can't be good...

A Department of Education probe went as far as releasing the names of 55 colleges and universities currently being looked at for their handling (or lack thereof) of sexual assault cases on campus.

Just because the school was named in the report doesn't mean there is a violation. But is does mean that the DoE is looking into something on campus...

“We hope this increased transparency will spur community dialogue about this important issue,” said Catherine E. Lhamon, assistant secretary for civil rights. “I also want to make it clear that a college or university’s appearance on this list and being the subject of a Title IX investigation in no way indicates at this stage that the college or university is violating or has violated the law.”

President Barack Obama created a task force to look at the issue after hearing complaints about the treatment of rape victims on college campuses. The results were released this week.

Title IX itself, as part of its language, prohibits discrimination in schools that get federal funding. Funds can be withheld if serious violations of Title IX are found by these investigations. But that really hasn't happened as a consistent by-product of digging...

A website is now up, notalone.gov, offering information to victims about past enforcement actions on campuses. Their lead paragraph:

Information for students, schools, and anyone interested in finding resources on how to respond to and prevent sexual assault on college and university campuses and in our schools.
