Civil Suit Filed Against Aaron Hernandez- Kraft Family And Patriots Named As Well...

((HT: MyFoxBoston))

And all of this has to do with the 2012 double murder Hernandez is accused in recently...

A civil wrongful death lawsuit against Hernandez was filed on behalf of Daniel Abreu and Safiro Furtado. Lawyers for the two families are looking to stop the New England Patriots from handing over the signing bonus that the NFLPA is looking to get for him as part of his last contract that he signed. The lawyers are also looking to freeze any assets left from the sale of Hernandez's $5 million suburban Boston home.

The lawyers for Abreu and Furtado want that money for their clients.

Here's the idea from the Hernandez camp

In another move, Hernandez's lawyers are looking to have their client moved to a jail closer to the city of Boston- since they have offices there and Hernandez also feel that their client's life is in danger.

From the motion:

"Surely there is now a reason to be seriously concerned about Hernandez's personal safety while housed at the Bristol County HOC and to question the ability of that facility's staff to treat Hernandez fairly and professionally while he is subject to their total control."

OSG High: Family Sues Over XC Death

((HT: WGRZ-TV))

The questions are around in the year-old death of a cross country athlete at the New York state championships from November 2012...

A 14-year-old runner fell during the practice sessions and the impact caused him to go into cardiac arrest...

His family is suing for negligence and wrongful death and questions the lack of an AED and an ambulance on site during the championships. The plaintiffs are going to have to prove causation and negligence for the suit to succeed- according to defense attorneys, and the AED issue may be resolved quickly in the discussions...

Here's the case and how it looks early on...
A spokesperson for Erie County issued a statement and it looks like they're trying to distance themselves pretty quickly from all the other parties accused in the case: "While Elma Meadows was the venue for the event, the event you are referring to was held by the NYS Public High School Athletic Association. Prior to the event, Erie County required that they procure insurance naming Erie County as an additional insured, which they did. Accordingly, Erie County is being provided with contractual defense & indemnification in this case under the insurance policy."

Odin Lloyd Family Files Wrongful Death Suit Vs. Hernandez

((HT: Fall River Herald News/Fraga))

Surprising no one really...

Odin Lloyd's family has filed a wrongful death suit against former new England Patriots tight end Aaron Hernandez...

They're also asking a judge for a restraining orders that would keep the Patriots from paying out Hernandez's contract and allowing for a "real estate attachment" on his suburban Boston home so it could still be considered an asset in determining his worth in a civil case disbursement...

There is no value floating around as to the worth of the civil suit and the attorney representing the Lloyds will be in court Thursday to argue their case.

Dolphins center Mike Pouncey was interviewed by a grand jury last week to discuss his relationship with Hernandez that goes back to their time at the University of Florida. Pouncey was served that subpoena to appear October 27th after a Patriots-Dolphins game in the tunnel after the game finished. Police believed at the time that Pouncey is a "material witness" who could "advance their case" against Hernandez.

They plan on working the angle surrounding interstate gun trafficking and Hernandez's possible involvement in it as part of his off-field behavior...

Here's the recap of the Pouncey grand jury visit...

Boogaard Family Sues NHL For Wrongful Death

((HT: NY Times/Branch))

Derek Boogaard spent his career as an NHL enforcer and was very good at his gig... too good until injuries sidelined him while he was under contract to the New York Rangers.

He was found dead last May after an accidental overdose of painkillers and alcohol. Now, his family is suing the NHL saying that the league is responsible for all the trauma his body suffered during his career.

Boogaard was, posthumously, diagnosed with CTE and the family attorney maintains that Boogaard was given medication to treat his pain, got him addicted, and didn't treat him.

The family maintains that the league violated their own protocol and continually gave Boogaard painkillers, through injection and pill form, and then had to send him to rehab for an addiction.

Once again from Branch where the 55-page lawsuit:

"...states that the N.H.L. “breached its duty” to Boogaard by, among other things, failing to monitor his prescriptions or establish proper procedures for administering and tracking them. It alleges that the substance-abuse program knew that Boogaard violated its rules many times — including a series of failed drug tests in his final months and his admission that he sometimes bought painkillers illegally — yet never disciplined or suspended him, as program rules dictate."

The Boogaards were interviewed by the New York Times about Derek's job and its dangers...

The family filed the lawsuit to beat the statute of limitations in two states- Illinois and New York...
