Kevin Ward, Senior Lashes Out At Tony Stewart

((HT: Syracuse Post-Standard/Hannagan))

The father of the sprint car racer killed in an accident with Tony Stewart has spoken to Syracuse media and is still not happy with Stewart and how things transpired on the track.

In an extensive interview with Syracuse.com's Charley Hannagan Kevin Ward, Senior feels that Stewart is solely responsible for what happened at the Canadaigua, New York track this past weekend.

From Hannagan is the collection of her quotes from Kevin Ward, Senior:

"Apparently, Tony Stewart was the only one driving out there who didn't see him," he said.

"Tony Stewart was the best damn driver by far on the track that night. Why he had to go up as high as he did and hog my son, there's no reason for it," Ward Sr. said.

"The one person that knows what happened that night is possibly facing 10 years in prison. Is he going to say what he done?" Ward Sr. said.

Ward wants everyone to remember his son as someone who just loved to race and that seems to be the main reason he spoke to Hannagan for her article. But even if the investigation shows no malice on Stewart's behalf, he may not be completely free from any kind of charges from the Ontario County police.

"CBS This Morning" brought in Jack Ford to discuss the legal options...

Mookie Blaylock Up On 14-Count Grand Jury Indictment

A suburban Atlanta grand jury has returned 14 counts against the former Atlanta Hawks guard in the 2013 crash that killed Monica Murphy. The 14 counts include 2 counts of felony homicide by vehicle.

Police said Blaylock left the northbound lanes of a Clayton County (GA) road, went into the southbound lanes, and crashed into the other car. Blaylock's license was suspended and had been told by physicians, according to the county district attorney's office, that he wasn't supposed to operate a car because of seizures that were being treated by medication.

Blaylock’s attorney, Don Samuel, said that doctors never told his client not to get behind the wheel of a car. He is refuting what the investigators are saying about the idea of Blaylock being told by doctors not to drive.

Blaylock has had several arrests involving 6 DUI charges in the past, but never had to serve any substantive time behind bars on any of the charges.

Here's the story from the time of the accident when the sheer volume of Blaylock's DUI's came forward...
((HT: 11Alive.com))

Blaylock could face up to 33 years in prison if found guilty in the upcoming trial.
No date has been set for the Blaylock trial.

Club Where Josh Brent Drank Promoted Excessive Drinking

((HT: WFAA-TV)) Something called the Texas Alcoholic Beverage Commission has come out with a study in and around the Josh Brent incident where Brent's drinking and behavior behind the wheel ultimately led to the vehicular death of teammate Jerry Brown, Junior December 8th... The Dallas club where Brent partied was found to have displayed "sufficient evidence" that employees served alcohol to intoxicated customers and encouraged "excessive" drinking. The TABC said they will not pursue action against Beamers Private Club until Brent's intoxication manslaughter trial has been completed. Beamer's could face a fine or have their license suspended or revoked. Here's the look from Dallas... Brent's BAC was found to be a .189 the night of the wreck- anywhere from two to three times the legal limit depending on the state you're in...

DEVELOPING: Blaylock Charges Upgraded (MONDAY UPDATE: Blaylock Turns Himself In)

((HT: AJC/WSB-TV))

So much for just the two minor charges...

With the death of Monica Murphy, the charges in the accident involving former NBA-star Mookie Blaylock have now been added to a few times over.

Second-degree vehicular homicide
Making an improper lane change
Driving on the wrong side of the road
Driving on a suspended license and,
Crossing into the median

All of the charges are misdemeanors, but Blaylock’s charges could be added to again when toxicology tests come back. Second-degree homicide means that the Clayton County (GA) DA's Office thinks there was no malice aforethought when Blaylock's car crossed the center line.

Here's Tom Jones with the husband of the woman killed in the acident
If Blaylock is found to be under the influence at the time of the accident, the vehicular homicide charges will be upgraded to first-degree... MONDAY UPDATE: Using a walker, Blaylock turned himself in to ... When asked about the crash, Blaylock only said, “No comment.” His wife told Jones he feels horrible about it. Naturally... Tom Jones was there when it all went down before Blaylock was transported to the county jail...

Ex State Trooper Gets Prison Time In Manslaughter Death Of Braves Trainer's Wife

((HT: AJC.com/Stevens))

Atlanta Braves trainer Jeff Porter and his wife, Cathy, were heading to the Chick-fil-A Bowl on New Year's Eve, 2011 when Georgia State Trooper Donald Crozier broadsided the Porter's car as he was on his way to assist in a high-speed pursuit.

Cathy Porter was pronounced dead at the scene and Crozier was charged with vehicular homicide, reckless driving, and violating his oath of office. Crozier initially would not plead to the oath violation charge, but today relented...

He was found guilty in the court case and has been sentenced to two years in prison with another eight years of probation added after his release. Crozier, it was discovered, had a history of wrecks in his GSP career and was dismissed shortly after the Porter accident.

Crozier apologized in open court to the Porter family and has been ordered by the judge in the case, Fulton County (GA) Superior Court Judge Craig Schwall, to assist in the education of other officers in the dangers of attempting high-speed pursuits.

Here's how the state proceeded after Crozier pleaded guilty to two of three initial charges...

Ex State Trooper Indicted In Crash That Killed Wife Of Braves Trainer

((HT: AJC/MyFoxAtlanta))

Here's your primer from back on New Year's Eve 2011
Marc Teichner has the story at the time...
Atlanta News, Weather, Traffic, and Sports | FOX 5

Christopher Seward now updates that Crozier has been indicted on charges of homicide by vehicle in the first degree, reckless driving and violation of oath by public officer.

Porter, obviously, isn't commenting- from Spring Training or anywhere...

From Seward's piece:

An investigation found Crozier had activated his lights and sirens, but the trooper did not slow his Dodge Charger patrol car enough to make sure the Porters’ Ford Expedition, which had a green light, had yielded to his patrol car before proceeding through the intersection.

Crozier, who had been on the force for 10 years, was fired after the incident. He released a statement following the accident expressing his sorrow. “I am so sorry for their loss and I think of them and pray for them every day,” he said in the statement released by his attorney.

The case will be heard in Fulton County (GA), but no date has been set yet...

Amy Senser Hearing Postponed, Joe Senser Slams Prosecutor

((HT: KSTP-TV))

Joe Senser decided that he was "going to level the playing field today."

In a post-hearing press conference, former Minnesota Vikings tight end Joe Senser went after the prosecution for (what he feels) is them lying about the state of his wife the night she was involved in the hit-and-run accident that killed sous chef Anousone Phanthavong in August of 2011.

Amy Senser was convicted of criminal vehicular homicide and appeared in court for the second time asking for her release from prison while her appeal is being analyzed. Her first attempt was dismissed on a technicality when the judge involved failed to give a reason when dismissing.

Prosecutors from the Hennepin County (MN) DA's office claim Amy Senser would be a flight risk, while her defense team dismisses that notion...

The judge feels he will have a decision by the end of the week...

Here's the decision...
She was convicted on two felony counts: Leaving the scene of an accident and failure to promptly report an accident along with an additional misdemeanor and will serve an additional 90 days in a halfway house- the sentences to be served concurrently. Here's KSTP-TV's version...

Note To Judge May Alter Senser Case

((HT: MyFoxTwinCities))

A note to the judge has been discovered in the case file in the Amy Senser proceeding after the jury delivered their guilty verdict last week.

It may give the defense all they need for their appeal...

The note let the judge know that the jury thought that Amy Senser ran over something and not someone...

Here's Tom Lyden with the revelation...

Senser could face four years in prison for her charge, but her defense team may argue that, since the jury had questions the verdict may be in question...

Amy Senser Guilty On 2 Of 3 Felony Counts

Amy Senser has been found guilty on two of three felony counts of criminal vehicular homicide in a hit-and-run death incident from August of 2011. The jury deliberated for 19 hours and sentencing is set for July 9th.

Senser was found guilty on one count of criminal vehicular homicide-failure to stop, and a second county of criminal vehicular homicide-failure to notify police. She was found not guilty on criminal vehicular homicide-gross negligence. She was also found guilty on a lesser count of careless driving.

"We'll ask the court not to send her to prison," Amy Senser's attorney, Eric Nelson, said. "That's a reality she has to face... I think she's prepared for that possibility but it certainly scares her."

Prosecutors portrayed the Senser family as a generally uncaring lot while Nelson responded with the idea that the Senser's high profile is the reason the prosecutors are looking at the charges they did.

Meanwhile, the family of Anousone Phanthavong is thankful that justice "was accomplished..."
((HT: KSTP-TV))

The lesser charge of careless driving carries a maximum sentence of 90 days in jail in the state of Minnesota. The two felony charges could carry a sentence of up to four years.
