McQueary testifies about what he saw Sandusky do

And the buildup to the inevitable trial of former Penn State assistant coach Jerry Sandusky continues.

The latest. On Friday afternoon in a Harrisburg, PA courtroom, the preliminary hearing for Penn State Athletic Director Tim Curley and former VP Gary Schultz, who are accused of lying to the grand jury about what they knew.

The key testimony of the day. That of current PennState assistant Mike McQueary who apparently came across Sandusky doing something that didn't seem to be right with a 10-12 year old boy in the shower at the teams locker room facility.

McQueary told the courtroom he heard slapping sounds when he walked into the shower area and then saw Sandusky and the boy. He said Sandusky's hands were around the boy's waist.

McQueary added he never described the encounter as "rape" or "intercourse", but he believed based on what he saw and heard that was going on.

After he left the area, McQueary said he went home and told coach Joe Paterno what happened the next day. Paterno, in his statement to the grand jury said McQueary came to him and reported he saw something of a "Sexual Nature" but Paterno didn't press for details because he knew McQueary was very upset about what he had seen.

Paterno said he would pass on what he was told, but it was a week and a half later before McQueary would meet with Curley and Schultz and he told them the same thing. He said he believed both men took it seriously and was confident because of Schultz's position of overseeing campus police, the incident would be investigated.

It wasn't.

They both told the grand jury that McQueary never portrayed the seriousness of what he'd seen.

Sandusky's odd legal team has been trying to tear down McQueary's testimony and Curley and Schultz's lawyers also say it isn't enough to make the case legit.

The judge in the case didn't see it that way. District Judge William C. Wenner decided he had seen or heard enough.

He sent the case to trial.

Hockey Analyst accused of assaulting kid during Hockey Game

Mike Milbury, Hockey analyst for the Versus Network/NBC is in some trouble with the law.

The reason: He's charged with assault and battery on a 12-year-old December 9th at a Brookline, Massachusetts hockey rink.

According to Boston TV station WCVB, Milbury is an assistant coach for a team at the Jack Kirrane Ice Skating rink and is accused of doing something not specifically disclosed to the 12-year-old who plays for another team. The incident happened during a skirmish.

Without knowing details, one of two things appear to have happened here. Either Milbury grabbed and hurt a kid in the ruckus or he pulled someone off the pile and a parent got mad about it.

Either way he's wrong and will be in trouble for it. The question is how much trouble he will get in. That remains to be seen.

UPDATE--per ProHockeyTalk.com: Milbury's attorney says his client was intervening in an altercation between his kid and another player. Nobody was injured or threatened.

Barry Bonds sentenced....sort of

There is almost an end in sight for the never-ending Barry Bonds steroid saga.

Yes, we actually thought it was over today when a U.S District Court judge in San Francisco sentenced Bonds to 30 days of house arrest, 2-years of probation and 250 hours of community service plus a $4,000 fine.

All because Bonds was convicted of giving misleading testimony in front of a grand jury.

However...

Shortly thereafter, the judge delayed the decision pending an appeal by Bonds, which could take upwards of a year.

Quite honestly, we aren't quite sure what the cost of this prosecution is, but is it really worth it? The grand jury appearance was 8-years ago. Bonds has already lost most all of his credibility which is a far greater punishment then being confined to his house.

But then again, who are we to say.

More Sandusky: Getting creepier by the day

Today is the day we should learn more about what the administrators at Penn State did or didn't know about alleged child molester Jerry Sandusky.

There will be a preliminary hearing held in the cases of Athletic Director Tim Curley and former VP Gary Schultz.

The two men were charged with perjury after the grand jury report on Sandusky was released.

The report was formulated largely on the testimony of Penn State assistant coach Mike McQueary. McQueary allegedly saw Sandusky engaged in sex act with a young boy in a shower.

McQueary's story has been put in some question, he is expected to be the focal point of today's hearing and is expected to testify.

We hear that despite some reported discrepancy's in what McQueary said he saw, the public hasn't heard everything about his testimony. The gaps may show or clarify what has been released. Keep in mind a "Grand Jury" summary is just that, a summary. It doesn't detail entire transcripts.

Now...this all comes on the heels of what is arguably the creepiest comments yet by a Sandusky attorney. A legal consultant advising Sandusky's lawyer, attorney Karl Rominger, told a Harrisburg, PA TV station (WHTM) that Sandusky's admission that he showered with boys was because Sandusky was trying to "Help troubled children who don't have basic hygiene skills."

He added "Teaching a person to shower at the age of 12-14 sounds strange to some people, but people who work with troubled youth will tell you there are a lot of juvenile delinquents and people who are dependent who have to be taught basic life skills like how to put soap on their body."

Really!

Rominger later released a statement saying his statement has become "Somewhat exaggerated" by the media.

Uh...why would you EVER say something like that. To a TELEVISION station no less. It's one thing to make an excuse for something but come on...

Sam Hurd

We are guessing that Chicago Bears wide receiver Sam Hurd won't be participating in this Sunday's game  at home against the Seattle Seahawks. 

The reason.

According to Federal Agents, Hurd tried to buy 5-10 kilos (not ounces) of cocaine and a half-ton of marijuana a week for distribution in the Chicago area at roughly $2.8 million a month. He'll be arraigned Friday afternoon and is currently being held in the Metropolitan Correction Center in the Chicago area.

The investigation into the death of Indy car driver Dan Wheldon October 16th at the Las Vegas Motor Speedway has come to a conclusion.

The report says Wheldon suffered a "Non-Survivable Injury" when his head hit a vertical post on the tracks catch fence.

The report goes on to discuss in detail the conditions of the track and the driving that helped create the problem. It pays particular attention to the large grooves on the LV Motor Speedway track.

Alleged Tree Poisoner selling gear to cover expenses

This is weird. Although, we guess you gotta do what you've gotta do to raise money.

The family of the man accused of poisoning the Toomer's Corner oak tree in Auburn, Harvey Updyke, have created a website to help Updyke raise money to cover court costs and other expenses.

The site is offering T-Shirts, stickers and autographed photos. And yes, the t-shirts say "Free Harvey Updyke".

While we think this is morally wrong on multiple levels, we can't argue that the Updyke family has a right to do this. And we know, and think Auburn fans should be outraged by it. But again, there is nothing they can do about it.

Ultimately a court will decide if there is enough evidence to prove if Updyke did actually do what he is accused of. It's kind of sad that he has become somewhat of a regional celebrity, but these days it doesn't take much to get that title. And while we get the "Raising Money for Legal Expenses" part of this, the paying off the wife's "Back Surgery" isn't exactly something you can do by "Raising Money".

Not that we'd do it, but if an Auburn fan wanted to ask someone about whether the Updyke's registered as a "Non-Profit" or if they are charging taxes for the gear might be a good question to ask some folks in the "Authority" business.
