OSG High: Family Sues Over XC Death

The questions are around in the year-old death of a cross country athlete at the New York state championships from November 2012...

A 14-year-old runner fell during the practice sessions and the impact caused him to go into cardiac arrest...

His family is suing for negligence and wrongful death and questions the lack of an AED and an ambulance on site during the championships. The plaintiffs are going to have to prove causation and negligence for the suit to succeed- according to defense attorneys, and the AED issue may be resolved quickly in the discussions...

Here's the case and how it looks early on...
A spokesperson for Erie County issued a statement and it looks like they're trying to distance themselves pretty quickly from all the other parties accused in the case: "While Elma Meadows was the venue for the event, the event you are referring to was held by the NYS Public High School Athletic Association. Prior to the event, Erie County required that they procure insurance naming Erie County as an additional insured, which they did. Accordingly, Erie County is being provided with contractual defense & indemnification in this case under the insurance policy."
